The Insured is an allied health organisation that provides group home care to residents. A resident had an episode and locked her carer outside the premises and started a fire in the bedroom with a cigarette lighter. The property insurer covered the loss and sought rectification costs in the sum of $470,000 against the Allied Health insurer alleging negligence as the Insured failed to discharge its duty of care in ensuring incendiary items were not visible to the resident), and in contract for breach of the Residential Tenancy Agreement the Insured had with the owners of the Property.
Rectification costs of $470,000 were covered by the Insurer.
