The Insured, is a personal trainer who put together a tailored exercise program targeted the Claimants specific personal goals to lose weight and improve her general health and wellbeing. Over the weeks, the Claimant complained of a sore back when doing squats and the Insured insisted she persist with ball squats. The Claimant was taken to hospital due to unbearable back pain and the underwent spinal surgery. The Claimant has made a claim for damages including economic loss, medical care and loss of future earnings. Assessment of damages by panel law firm is in excess of $300,000.
