Claim Description
The Insured operates small personal training business. The Insured conducted a fitness training class and one of the participants was significantly overweight and passed away during the class suffering from cardiac arrest. The Insured had not completed any pre-exercise screening process. The Claimant in this case was the deceased wife.
Outcome
The Insured faced claims for psychiatric injuries suffered by the Claimant, a claim by the estate for funeral expenses and a claim by the dependents of the deceased for the loss of financial benefit from the deceased had he continued living. The Insurer has paid in excess of $400,000.
