Prior to the start of a group fitness class, an exercise bench was partially placed underneath a set of monkey bars. While performing the exercise, a participant dropped from the monkey bars and landed on the foot of the exercise bench. She lost her balance and suffered an injury.

The participant sought compensation from the insured fitness instructor, alleging that the instructor was negligent and did not create a safe environment.

The instructor’s insurer covered the claim and paid $219,418, including $44,418 in legal and other fees.
