Claim Description
An insured landscape contractor received a letter of demand from a client. It alleged that the contractor had damaged cables while excavating and sought $903 to repair the damage.
The insurer assessed the claim under the Public Liability section of contractor’s Business Pack. As part of their assessment, they requested evidence that the contractor had obtained plans showing the location of all cables on the property before starting work.
Outcome
Unfortunately, the contractor had failed to obtain the necessary plans before excavation work began. The claim was denied, as the policy excluded damage to fixed property unless the insured first “ascertained from the relevant authorities the actual position of any” cables before beginning work.
