Claim Description
An email for a dating agency was sent over 10 times to approximately 400 recipients. The ACMA prosecuted the insured marketing company responsible for sending the email. Under the Spam Act, they faced potential fines of $1.1 million a day for repeat corporate offenders and/or a penalty of $110 for each “unsolicited commercial electronic message” sent.
Outcome
The marketing company’s insurer appointed solicitors to defend the charges. As multiple emails were the result of a ‘technical glitch’, the charges were dismissed. The insurer covered $275,000 in defence costs for the marketing company under their Management Liability policy.
