Claim Description
A land surveying service conducted a survey of an underground stormwater pipe, which was used by an architect to design a two-storey house on the property. During excavation works, the builder discovered that the pipe was located only 300mm from the building structure—much less than the one metre distance mandated by the local council. As a result, the builder issued an invoice for $26,372 to the property owner for the cost of redesigning and repositioning the house to comply with regulations. The property owner sought compensation from the land surveyor, alleging the new costs arose from the incorrect surveying report.
Outcome
The land surveyor’s insurer reviewed the claim and agreed to cover it under the Civil Liability clause of their Professional Indemnity policy. The land surveyor paid the $2,500 excess, and the insurer paid the remaining $23,872.
